Some of my readers will recall that when Mayor Condon, Steve Salvatori, and Mike Allen were trying to sell the Tentative Agreement between the City and the Spokane Police Guild they had public meetings to grease the sales job. I attended the meeting at the West Central Community Center and spoke pointing out that the agreement was a joke and gave complete control of Oversight as well as Body Cameras to the Guild. I also very specifically pointed out that the OPO would never be able to conduct an independent investigation without compelling statements through Garrity. I directly asked Frank Straub if he would compel his cops to give statements to the OPO. Straub of course in front of the video camera said he would. Of course, as we know it has never happened. The very first memo OPO Logue should write to Meidl is a request to Meidl that during his investigation of the House of Charity OIS that ALL Cops be compelled by Meidl to give him statements under Garrity v New Jersey.

The problem Logue will run into is that the ultimate decision for compelling the statements from cops will be with Mayor David Condon, and we all know what happened when I recommended to Council President Stuckart that he try and force Condon to invoke Garrity during the Cappel Investigation.

Condon refused to do it!

What will also be interesting in this whole fiasco is the role new City Attorney Mike Ormsby who was Championed by none other than Mayor David Condon, his guy James McDevitt, and Council President Ben Stuckart.

Attention OPO Logue!!!

Aside from the House of Charity OIS, this one needs careful scrutiny especially the Body Camera Video, and the DFRB!

The OPO is ALL UNDER… UNDER FUNDED, UNDER STAFFED, UNDER AUTHORIZED, UNDER VOICED and will still be that way as long as the Unions have control. The only way out is through legitimate hard fought negotiations, which unfortunately Mayor Condon is responsible for, and not the City Council. No matter how hard Breean Beggs tries to get a new OPO Ordinance passed it is meaningless and it is time to face that fact. Condon and Straub threw away Prop I in the last negotiation, which by the way on the Guild side is being handled once again by Whitworth Grad Hillary McClure who easily kicked the City’s butt last time, and likely will again.

When all is said and done maybe the hiring of Teresa Sanders friend to be the Personal Trainer for all the City Staff might be a good thing as the City Council will likely need to get in shape for the battle ahead!



Well, he obviously does and on a much larger scale than Mayor Condon and SPD have. One has to assume that on the Federal Level there is a full court press to find the leakers. Here in Spokane, in case you have forgotten, I learned that our own “Leak Investigation” is still in full swing.


“What happens right now is someone calls Brian Breen and says ‘Hey, go request that one,'” Beggs says. “That should not be the way it happens.”


It has been nearly a month since the IA Investigation was started so I thought I would check in with SPD to see if they had rounded up the usual suspects and fired them or disciplined the heck out of them. I got this response.


“Hi Brian.

The “leak investigation” is not over. It is still on-going. Do you have a PRR for that investigation already?”

My response was pretty simplistic.

No PRR yet, I thought I would wait until you rounded up all the “Usual Suspects”!


McMurtrey the son-in-law of a retired SPD Cop certainly had every right to file an IA Complaint but I would have to wonder why other cops haven’t done the same, including for example current and retired Officers O’Brien, Ponto, Uberuaga, Harvey, Lynch, Burbridge, Coleman, Madsen, Cowles, Estes, Anderson, Pence, just to name a few. Maybe they have and I just haven’t heard about it.


I’m sure I exacerbated things for the Mayor and Craig Meidl when I submitted a PRR regarding the case of Officer John O’Brien.

So where do we stand on getting the real scoop on the McMurtrey cover-up PRR?

For folks that don’t recall my McMurtrey PRR actually forced Mayor Condon and Craig Meidl to have a press conference releasing the McMurtrey Body Camera Video a year or so after the incident took place.

It will be interesting to see how Meidl describes the O’Brien Body Camera Video, as far as being atrocious is concerned.

A problem Mayor Condon and Meidl might have if they decide to throw the book at O’Brien, is the precedent set in the non-discipline of McMurtrey. It is hard to tell how an Arbitrator might look at that if there is an appeal and Meidl’s public comments are well documented.

Of course the fact that the two individuals involved in both the McMurtrey and O’Brien cases are African American has to raise some eyebrows with the NAACP. Now that Ozzie’s, Craig and Traci Meidl’s good friend Phil Tyler has stepped down as President of the local NAACP it will be interesting to see how the NAACP handles this.

Perhaps Phil Tyler has plans, aside from his political ambitions, to end up working for Ozzie’s consulting business… who knows.


New leadership always means new directions.


Spokane Police Chief Craig Meidl attended the event. He said no one invited him, but he saw information about it on social media and wanted to come and show support for Spokane’s community of color.


“God tells us to bear each other’s burdens,” Meidl said.


We will always need Investigative Journalists to keep us informed, but it would sure be helpful if the Mayor, SPD, City Council, OPOC, and the OPO got their act together!





So, how is Mayor Condon’s “National Model for Police Oversight” doing these days?


If you were to watch the May 2nd, 2017 meeting of the OPO Commission it would give you a pretty good idea even without reading between the lines.


“This agreement includes the elements requested by the City Council and the public, and delivers to the community unprecedented independent oversight of its police department,” Condon said.


“On January 2nd, I sent a letter to Mayor Condon, on behalf of a majority of the City Council, asking that he reopen negotiations with the Police Guild to include independent investigation capabilities for our police ombudsman that align with the City Charter,” said City Council President Ben Stuckart. “I believe this new tentative agreement satisfies our request and takes a step forward for our community. I appreciate the Police Guild and the administration for getting this done.”


My, oh my… how things change!


Cops and their negotiation lawyers aren’t dumb, despite what some might think, they know full well that any Commission made up of “Volunteers” will include SOME PEOPLE with an agenda and ideology they want to push and the pushing always will result in chaos and dysfunction.
