“An Inept and Corrupt Media Breeds Corrupt Government.”

Four days before the election Nick Deshais writes an article pointing out that Mayor Condon and Frank Straub have been lying about Crime Data in Spokane. This isn’t embarrassing for Condon he could care less about lying to the Public, this is embarrassing to the Spokesman Review who have fed Condon’s lies in story after story. They even did a fluff story about Condon and Straub going to the White House where they both lied about crime going down in his administration. Did Nick Deshais and the Spokesman Review not even bother to check the statements? Were Nick Deshais and the Spokesman Review ever made aware Condon and Straub were lying? THE ANSWER IS OF COURSE YES THEY WERE AWARE!!

(**The Spokane City Council was also aware, I provided them with the same and more.)

For the last 3 ½ years I have continually pointed out that Condon and Straub were lying about the Crime Data. I continually pointed out and provided links to other Departments who like Spokane were feeding there Citizens phony CompStat Data. I even went so far as to make a complaint that Straub and Selby Smith had given Bunk Data to the City Council and the Public regarding Domestic Violence. That complaint was of course covered up and NOT investigated by Teresa Sanders. The Spokesman Review continually writes stories, and rightfully so, about the lack of integrity at the SPD, but no one in Spokane writes stories about the lack of integrity at the Spokesman Review.

I could easily provide documentation for comment after comment I have made pointing out the lies but in the interest of time and space will provide three. I will also provide media images below of just a few of several emails between myself and Nick Deshais where I demonstrated what was going on and he ignored it. Ignored it that is until four days prior to the election. The Spokesman Review because of their lack of journalistic integrity, and because this is such an embarrassment to them will likely go back and delete all my comments in the three links, so read quickly! If they do delete the comments I will post screenshots of the comments.

DOES ANYONE RECALL?

People saying over and over again that SPD is a mess and continues to be!

One of the big reasons it is a mess is simply because there is NO ACCOUNTABILTY and the media continues to let the Mayor, City Council, and Police Administration off the hook. When the SR has the perfect opportunity to ask pointed and delving questions they don’t! The question is why they don’t, and if you take the time to read my previous blog posts you would understand why I initiated a FOIA request after receiving an anonymous letter indicating the SR was spiking the Straub/Cotton stories. Here is a quote from the letter “Then before any more press comes out an associate of the Mayor, with ties to the review get this continuing story held until after the election.” (See copy below).

Is there any question why the SR are doing all they can to silence me? There shouldn’t be! Is there ANY QUESTION cops don’t like oversight or criticism. NO! Is the same is true for the media? YES!

Why are these questions not being asked?

1) Given what is happening now with SPD and your public statements about all of the positive reforms that have taken place don’t you now feel that those public statements were exaggerated?

2) The reasons you have given for requesting the resignation of Frank Straub were based at least in part by his Senior Staff alleging he was untruthful and was misrepresenting you, the City Administrator, and others, certainly you must know the specifics of his untruthfulness and how he was misrepresenting you. Will you please explain with specifics what those issues were?

3) When you hired Frank Straub, both Straub and you made the decision not to conduct an administrative investigation into the allegations associated with the Karl Thompson case which included the Department of Justice pointing out that officers had tipped off Karl Thompson regarding the Zehm investigation and in fact had lied to protect him. Those same type of allegations have surfaced again in the Ennis case. Although Officer Moses retired, Officer McIntyre remains on the Department. Frank Straub’s press conference after the Thompson verdict again stressed the need to put the Zehm case behind the SPD. Looking back was the decision you and Frank Straub made not to investigate and discipline officer conduct in the Zehm case one of the reasons we are where we are today with respect to a questionable culture?

4) Recently Frank Straub allowed Lydia Taylor who was found to be lying during an internal investigation into steroid usage to remain a police officer over the objections of her review board. You could have overruled Straub’s decision but chose not to. Do you feel in retrospect that allowing Lydia Taylor to remain on the SPD may have contributed to a culture where untruthfulness, and obstruction of investigations is an acceptable standard if the punishment for doing so will not result in termination?

5) The current Guild contract does not include standards for steroid usage in the drug testing potion of the contract. Do you intend to attempt to rectify that?

6) Independent Culture Audits are common place in the private sector, and a previous “Culture Audit/Study” was conducted upon the SPD by WSU (WISCO) back in 1993, the lead analyst in that study was Dr. Quinton Thurman who was at WSU at the time, have you reviewed that study and the analytical process involved or any of the analytical approaches to “Culture Audits in the private sector?

7) When will you be providing Brian Breen with the text messages regarding the Straub/Cotton issue, the ones he confronted you about on the Mike Fitzsimmons Show and you stated you and Frank were going over and he would get all of them? We understand Breen recorded that portion of the radio show.

Hell…I could come up with 100 more that should be asked but never will be.

On Wednesday interim Police Chief Rick Dobrow said that an internal investigation has been launched to determine if any officers hindered the investigation into the alleged assault.

Dobrow said during Thursday’s press conference that his department is cooperating fully with the investigations into the alleged assault and the alleged evidence tampering.

Why…if you are trying to test your ability to do a parallel IA with Criminal Investigation like COPS/DOJ recommended would you use this case Chief Dobrow?

Needless to say the latest escapade involving the SPD brings out the best in anti-cop diatribe on the comments thread. Don’t misunderstand IF all of the various allegations are true the community has every right to complain. The problem is at this point as in the case of every sexual assault the truth isn’t known, and unfortunately might never be known.

As many people are aware I have the ability to determine exactly who posters are that comment in the SR comment section. It was quite easy to determine that NOT ONE of the people commenting have any experience what-so-ever in the investigation of sexual assault cases so I thought since I have been qualified as an expert on sexual assault in court, have investigated well over 1,000 sexual assault cases, wrote the sexual assault investigative protocol for the SPD, as well as doing detailed analysis of sexual assault cases including serial rape cases, I might have far more insight than any of the individuals commenting. Beyond my investigative background I have spent untold hours advocating for victims of sexual assault and for years volunteered my time to help victims with Lutheran Community Services Rape Crisis where I did a number of things including at one time confronting Anne Kirkpatrick face to face along with the LCS Director regarding complaints about despicable comments an SPD Sex Crimes Detective made to victims in the presence of several victim advocates. So to have two people (Sled) and (Shelalal) question my concern for victims is laughable and simply and attack based solely upon their hatred of all things law enforcement. I will deal with the truth concerning Chase and  Scheldt at a later date including their true backgrounds, the false stories they have made up and posted in the comments section of the SR and why, including questions of perjury false statements and claims, foreclosure, debt judgments, etc. In simple terms putting an end to the honest holier than thou persona they portray on internet blogs.

Let’s start with a few facts as it relates the release of court documents even though I have mentions the issue before.

FACTS:

1) Any Citizen can go to the Court House and obtain the very same un-redacted document obtained by the SR and KHQ. So if anyone really wants to know who the alleged victim is just jump in the car and grab some copy fee money.

a) One of the reasons I pointed out earlier the need to not identify sexual assault victims both children and adults by name or identifiers in search warrant or arrest affidavits.

b) The parties to a search warrant have seven days to object to the documents being placed in a public file every cop knows that because they read it to the individuals when the search warrant is executed. Apparently there was no objection on the part of Ennis or Strosahl so they must not have cared much whether it was in the public or not. The purpose of the rule is to protect both the suspect and the victim.

c) The sexual assault investigators in order to protect the victim, or for that matter the suspect from the facts being made public, could have objected but apparently did not.

d) If a criminal or civil case does go to trial the name of the adult victim will be made public.

2) When the SR or other media does not post a redacted version of the affidavit the readers or viewers are left with a narrative of what the reporter wants to convey which is all too often an inaccurate description of the probable cause presented in the affidavit. A perfect example of what I’m talking about is displayed in the media below where SR reporter Kip Hill posted on his blog how reporters prepare the narrative and tell a story. Despite Hill’s statement that crime reporting is “Easy as pie” and his job “as a journalist is always to provide context by telling a story”, according to friends who are real crime reporters in real markets when I shared his blog post with them, Hill’s perceptions regarding crime reporting might be okay if you are writing a book but not when you are reporting crime. When I brought Hill’s post to the attention of Alison Boggs at the SR her only response was no big deal, I’ll talk to him. I of course maintained those emails.

I could probably go on and on regarding the investigation of sexual assaults, how difficult they are to investigate and why it so necessary to do them right from the standpoint of establishing the facts in the interest of both the victim and the suspect but I will spare you.

Well, checking the SR story today I see it has resulted in the advertising clicks the SR so desperately needs especially with Stacy Cowles apparently wanting a 2 million dollar cut. As expected Addy Hatch who is responsible for what the SR reporters put out offers her typical phony excuse when someone mentions my name. The TRUTH is I embarrass the SR and they haven’t run up against someone willing to take on the local power structure so trying to silence that person is their only option.

Below is a link to a document I downloaded along with many others from the SR website that were un-redacted yet left for the public to see until someone complained and in a lot of cases the complainer was me and I have the emails to prove it. Don’t get me wrong I’m all for not making public cops addresses and phones but it isn’t like the SR hasn’t posted many other people’s in the past so “ericdx” is exactly correct on the SR’s selective policy.

BTW, I haven’t really studied the Twitter Analytics yet but over 5,300 “impressions” seems like it might be pretty good. I imagine it is a diverse group including cops, politicians, reporters, along with John and Jane Q.

Another black eye for SPD whether or not there was a sexual assault. I of course have some observations regarding the SR story and would urge caution to anyone in drawing any conclusions at this point regarding the alleged sexual assault. I would also urge people to actually read the court documents either in the links provided here or from the KHQ website.

Unfortunately the SR story leaves out a lot of information that would have been useful and informative to their readers and could paint the wrong narrative depending on what the facts actually are. One thing that struck me from the beginning was there is no mention in the story which agency is investigating the case. After reading the story my first thought was that I hoped SPD had sense enough to farm it out to another agency as it involves their own. THE FACTS ARE THEY DID. How do I know you might ask? I simply went to KHQ the SR’s TV counterpart where I found that the same court documents the SR had were posted and linked so that there viewers and readers could get the FACTS for themselves and even download them if they wanted to. KHQ had done exactly what a blogger with the persona “emerson.cook” (Yes I’m “emerson.cook” one of many personas since being banned) suggested to both Addy Hatch and Nina Culver. Both Hatch and Culver rejected the suggestion, citing SR policy. THE FACTS ARE the SR, just like other media has in the past posted and linked redacted sexual assault reports and court documents they have received. ANOTHER FACT is the SR as actually posted and linked UNREDACTED documents they received, most notably in the Rachel Dolezal case, but there are several others. I won’t bother with the Carlisle murder case documents they also released.

So the question remains: Is the SR going soft on SPD and if so why?

I have done one heck of a lot of sexual assault search warrants in my time and after reading this one have some concerns I won’t bother to get into here and I don’t mean to say it is a bad search warrant. I will mention this however. The parties to a search warrant including the State have the option to attempt to bar the release of the search warrant and affidavit to the public by going to court and requesting they not be placed in the public file. The reason the law allows for this is two-fold, first to allow a continuing investigation to remain confidential, and second to protect individuals from the embarrassment of public disclosure of allegations that may later prove to be false. Why that wasn’t done in this case is beyond me. Although most of my posts as “emerson.cook” have been left on the SR comments section the comment where I point this out was deleted for some reason, and of course the comments on that story were closed early which probably was a good idea.

As fate would have it Keyboard Commando and Suck-Up “Sled” (Andrew Scheldt) continues on the wrong path. I hope “prior LEO” “ts52” isn’t too embarrassed about the comments he made toward me in the comments section after he reads this blog post and finds out I was correct.
