I have very little control over when I come into possession of documents relating to Criminal Justice Issues, believe it or not sometimes it is over Holidays or on Weekends despite what some might think. Inevitably, once I come into possession of certain documents often it requires a Public Records Request not only to confirm authenticity but also to try and get the full story. Obviously, this doesn’t make me real popular with Public Records Clerks but someone in the Media must do this kind of stuff to try and keep OUR employees honest and above board.

The PRR I submitted today could easily have some far-reaching effects on several issues including a very high-profile Criminal Case, as well as the “Good Old”, “Lets hide this sucker it makes us look awful!”, the same things I ran into with the Officer Chris McMurtrey case, a case where Chief Craig Meidl publicly admitted would not have seen the light of day if it weren’t for my PRR. Like the McMurtrey case the information I am seeking is over a year old and may not have ever come to light because of the SPD transparency problem.

At this point I have reached out to some folks to get some answers from them regarding their handling of the case, and I will tread somewhat lightly until I get answers from them.

We will have to see how this one turns out, but based on what I do have in the way of documents it could get real ugly and explain why top City Administrators aren’t onboard about letting the Public know about improprieties.

Ozzie is somewhat notorious for reacting to media stories that he feels don’t put him in a good light, whether it be the Spokesman Review, The Inlander, TV Folks, or me. Well as you can see from our email exchange today once again it is this humble reporter he chooses to take a shot at.

I always offer Ozzie a chance to comment or correct anything in my stories, up until today he has been completely ignoring me, however today something must have really set him off, so he gave me (rhetorically speaking) the wrong end of that shotgun he keeps by his bed because of Maclay.

It is hard to say if Ozzie was referring to the 1981 movie starring Paul Newman and Sally Fields which did deal with libel and journalism, or this:


Public figure doctrine (absence of malice)

In the United States, special rules apply in the case of statements made in the press concerning public figures, which can be used as a defense. A series of court rulings led by New York Times Co. v. Sullivan, 376 U.S. 254 (1964) established that for a public official (or other legitimate public figure) to win a libel case in the United States, the statement must have been published knowing it to be false or with reckless disregard to its truth (also known as actual malice).

Under United States law, libel generally requires five key elements: the plaintiff must prove that the information was published, the plaintiff was directly or indirectly identified, the remarks were defamatory towards the plaintiff’s reputation, the published information is false, and that the defendant is at fault.



My best guess is Ozzie was referring to the “Public figure doctrine” as a veiled threat to me that he might sue me. Kind of like the lawsuit Ozzie helped Travis Pendell bring against Deplorables Matt Shea and Scott Maclay in which I have no doubt the “Public figure doctrine” will come into play.


Heck, after 40 plus years in the investigative business I’m so used to threats it has become second nature for me to just say; “Poop or get off the pot Dude!”, you will just love the counter suit and I ain’t no “Public figure”.


Yes, it is true, reporters do sometimes work on Holidays… and weekends. I think the public photo of Ozzie and his wife Paula is kind of sweet and humanizing. Maclay of course types every word for me and has final edit authority on all my stories, and where in the hell is that assault report Ozzie…records doesn’t have it have you got it hidden away somewhere? Okay…got it the Death Threat Investigation has exceeded a year and is ongoing…so cough up the reports!

Where in the hell is the Death Threat Investigation Report Ozzie? The Pend Oreille County Prosecutor doesn’t have it, the Spokane County Prosecutor Doesn’t have it, and Records doesn’t have it, so who the hell does have this mysterious report Ozzie?

The truth is when Ozzie overtly displays his “radicalized hatred” for all the Deplorables, including recently in front of witnesses, he not only makes a fool of himself but also his entire office and the good Deputies therein, to say nothing of the Prosecutors Office. We Deplorables are going to have to get together and compare notes on how many times Ozzie has gone to Larry Haskell trying to get one of us charged with a crime like Ozzie recently did with me… I bet it will take me all the upcoming weekends and Holidays to PRR all of those meetings! 🙂

Obtaining reports and records which support Sheriff Knezovich’s official report regarding the arrest of Michael Scott Maclay has been challenging to say the least. One would think if there was in fact a year long investigation of death threats and a bounty placed on the life of Sheriff Knezovich the reports regarding that year long investigation would be right at Spokane County’s fingertips, after all an elected Public Officials life being threatened doesn’t happen every day in these parts. If an investigation did take place you would expect to find a load of police reports including witness interviews, recorded statements, surveillance reports, suspect interviews and all kinds of other documentation especially when you consider the SCSO Reporting Policy.


At this point, in response to my October 28, 2017 which was a request for the records of this year long investigation I have not received any responsive records from the Spokane City/County Records Division. On November 4, 2017 in response to my October 28, 2017 PRR I did receive one unresponsive document (even though my PRR was very specific) from the Spokane City/County Records Division, that document was just the arrest report of Michael Scott Maclay, which obviously I already had.

The way it works is the Records Clerk will conduct a database search based upon the involved individuals’ names, DOB, addresses, etcetera, or a report number if it is available and then provide requestor with a copy of the report. Assuming the Records Clerk preformed the required diligent search, it means there is NO POLICE REPORT regarding a year long investigation of death threats made by Scott Maclay against Sheriff Ozzie Knezovich. My original PRR went to the County who in turn forwarded it to the Spokane City/County Records Division, just to make sure no report exists it was necessary for me to do another PRR directly to the Spokane City/County Records Division so there can be no mistake.

Some folks not familiar with how the Criminal Justice System works might wonder why establishing these facts or non-facts is important, in this case the answer is simple Sheriff Knezovich in his official report states that upon arriving at University High School at approximately 13:20 hours and observing the presence of Scott Maclay he immediately advised his Deputies “that for over the past year there has been an investigation concerning alleged threats Maclay has made concerning my life” and “that approximately month ago Maclay placed a bounty on my head”.

It is quite clear from the reports made by Deputies involved in the arrest of Maclay that the information Knezovich gave them was used by them as an element of reasonable suspicion/cause to interact with Maclay.

If the information the Deputies received from Knezovich regarding a yearlong death threat investigation was not true, as it certainly appears that his statements about his wife being assaulted are, it could very easily, among other things, taint Knezovich’s arrest of Maclay, a man he clearly despises, and would be quite problematic for any Prosecutor if charges were filed against Maclay and Knezovich was forced to take the witness stand.

Beyond a criminal case, it would also be very problematic in any subsequent civil litigation that might arise from the Maclay arrest. If there is a subsequent civil litigation against Sheriff Knezovich and Spokane County, it of course would be on the taxpayer’s dime so IMO it is important to attempt to get the facts and the truth as soon as possible.


There is quite a bit of speculation on the part of very seasoned investigators I often interact with that ultimately, the only thing I will end up with because of my PRR is a boat load of Facebook/Twitter posts, innocuous emails, and no real investigative reports into a year long death threat investigation into death threats. I’m hoping that doesn’t turn out to be the case, but we shall see.

Although, Sheriff Knezovich on two occasions in his official report made under the penalty of perjury stated that Scott Maclay assaulted his wife (Paula) at an event in October 2014 there is no record of an assault report being made according to the Spokane Police/Sheriff Records Division. This new information is very troubling especially since some of the information Knezovich provided to his deputies and in his official report do not appear to be true.

Maclay himself denies ever having assaulted Mrs. Knezovich, or ever being contacted or interviewed regarding an assault upon Mrs. Knezovich.
