As an update to my earlier story today I just received this from Brian Coddington in my Media Email Folder.

 

The backstory to all of this is typical HSS (Hilarious Spokane Stuff), needless to say and as expected the “Nasty Women Born in January” refused to quietly resign and fade into the sunset. So how long she stays on the OPOC is a question mark. As soon as someone else is appointed she legally has to be gone from the OPOC, or if no one steps up to the plate she can cause havoc until 90 days after September 15^th, 2017 which is when her term ended.

 

In the meantime, I’ll just be sitting back waiting for my PRRs.

Trust me, the Spokane Police Guild as well as the Lieutenants and Captains Association didn’t underestimate anything when they agreed to a contract clause that established the Office of Police Ombudsman Commission for Mayor Condon’s “National Model of Police Oversight”.

Yup, the Unions knew full well that any civilian review commission or board would end up exactly like they all have in the past, a political quagmire with an inability to accomplish anything, and yes folks that is exactly where the OPOC and the OPO are today, in a political quagmire where the Mayor, and City Council can’t figure out how to get rid of OPOC Chair Debra Conklin despite a number of complaints about her conduct and attempts to completely dominate an oversight panel in the interest of forwarding her own agenda and ideology.

In the case of Rachel Dolezal fear of alienating the African American Community prevented movement on the part of the politicians to do the right thing, and we all know what great national headlines that resulted in. In the case of her replacement Chair Debra Conklin some politicians are in great fear of alienating Debra Conklin’s very Liberal followers and a voting block they need to get re-elected.

Documents which include electronic interaction between Conklin and Councilpersons paint the ugly picture, as does other communications responsive to my Public Records Request which I submitted back in May 2017 and have yet to receive.

Conklin’s disdain for OPO Bart Logue is very well known throughout City Hall as well as among many of Conklin’s followers. Her disdain for Logue likely not only stems from his military background but also from the fact the Conklin was unable to get her guy Canadian Raheel Humayun the job.

Conklin’s demeanor during the OPOC meetings when discussion turned to re-opening the search for an OPO when her guy couldn’t get a US Visa and her statement that only “Second Tier” candidates would apply pretty much says it all… she considered Logue who was interim OPO at the time “Second Tier”, despite the fact that both Mayor Condon and Council President Stuckart recommended the OPOC hire Logue.

In character when it comes to law and ordinances, including the Public Records Act, Conklin wanted to tweak the OPO Ordinance to get her guy Humayun the job.

“Commission Chairwoman Deb Conklin suggested tweaking Humayun’s visa application and having him apply again at the Canadian border, an action recommended by an immigration attorney who has consulted with the commission.”

Even though Logue was eventually appointed to the OPO job, when Conklin figured out his appointment was inevitable she of course still got her shot in at Logue by articulating her preference for MacConnell… no surprise there!

 

“Four commissioners voted unanimously to offer Logue the job, though before the vote, commission chair Deb Conklin said she thought the other candidate, former Phoenix police officer Jacquelyn MacConnell, was stronger.”

“She’s a person who comes with a lot of creativity and energy and a willingness to think outside the box,” Conklin said.

So, What’s the Latest?

 

As the email exchange below clearly demonstrates Logue has decided to take the high road in the interest of trying to not make Spokane Police Oversight a complete joke.

 

I have lots more coming on this issue including the requirements set forth in the Nissen v Pierce County case where the Washington State Supreme Court directed the Pierce County Prosecutor to obtain transcripts via his carrier Version and turn them over to Pierce County. What say you Mr. Ormsby?

About the only thing Debra Conklin and I have in common is we were both born in January, and admittedly although I can be “Nasty” at times, I think I’m more of a Curmudgeon than just outright “Nasty”. Having said that, I did try and find an image of a t-shirt that said “Never Underestimate A Nasty Man Who Was Born In January” to include with this story but I was unable to find one so if anyone has one please pass it along! 😊

When it comes to forcing transparency why do I always have to be the bad guy? Other reporters file Public Records Requests why don’t they hit? Oh… wait a second I forgot about some of those emails I have! 😊

The gals in the City Clerk’s Office were right on top of the situation and shortly after I published my September 20, 2017 story concerning Debra Conklin they were able to find some responsive records which they sent to me right away on September 20, 2017 at 11:37 AM.

The images below show OPOC Chair Debra Conklin’s response to Terri Pfister’s certified letter and email trying to get some action out of Conklin. Keep in mind this was a May 21^st, 2017 PRR and at this point MOST people identified in the PRR have provided responsive records to the City Clerk’s Office. The City Clerk’s Office, and City Legal I’m sure, are currently in the process of reviewing those records for proper redactions etc.

I’m not going to say much at this point about Conklin’s responses, I will mention that given what I know I find them odd at best.

 

 

She FINALLY turns in her phone via her trusted companion Martha Huseman (more later). You always want to wait on signing any affidavit until you can figure out what Breen has! 😊

I’ve been holding off on this until the Freeman School shooting subsided at least a little bit, but two City Council Members, Lori Kinnear and Breean Beggs, are letting fear of the wrath of the “Shaded Lady” stand in their way of doing the right thing. The question is, are they afraid that OPOC Chair Deb Conklin’s very liberal backers, which make up a big part of their own election constituency, will be unhappy?

You can see some of that wrath, which several others have experienced, displayed on the video of the September 6^th, 2016 OPOC Meeting starting at the 11:37:29 mark.

There is quite a bit more coming soon, this is just kind of a teaser, Deb Conklin wasn’t reappointed to her current position even though her term ran out on September 15^th, 2017, the reason was that there weren’t enough votes on the City Council to reappoint her, so now her existence on the OPOC is entirely in the hands of Kinnear and Beggs. She can stay in her position without reappointment for 90 days and both Beggs and Kinnear are aware of among other things a press for an Human Resources Complaint against her, so this should be interesting. At least Mayor Condon dispatched Rachel Dolezal rather quickly, but for some reason the City Council can’t seem to get it done in Conklin’s case.

At this point I’m waiting for City Clerk Terri Pfister to provide me with Conklin’s response to the certified letter they had to send to Conklin since she simply ignored the first responsive documents request they sent to her about my May 21, 2017 Public Records Request. Yes that’s right May 21, 2017!

 

 

I think the gals in the City Clerk’s Office have a pretty good idea that I know prior to submitting a PRR what is in the responsive records, you would think by now that the City Attorney’s Office who carefully scrutinize my PRRs and help Ms. Pfister and Ms. Farnsworth out with the email responses they send me would realize that also.

Anyway, since the gals in the Clerk’s Office kind of follow my blog a bit… Here you go Terri!

The third paragraph of Deb Conklin’s response states exactly this;

“Mr. Breen’s attempt to smear me with the recording of the June 6 OPOC meeting is even less successful. Once again, it is clear from the whole of that meeting that the problem is HOW, NOT WHETHER, to get the texts to the city. There has never been any suggestion, in private or in public, that I would not comply fully with this PRR.”

I hope that will help you find the document Ms. Pfister.

Ms. Conklin, you should probably take note as well, that as far as the two Assistant AGs you were with on your vacation, one since retired, who supposedly “strongly urge” that the City should immediately get a subpoena to serve on T-Mobile, surely, they must know that an Administrative Subpoena likely wouldn’t work in this case, and there isn’t an open Civil or Criminal case. So why don’t you just get the data from T-Mobile yourself as was done in the Nissen case? Also, since you often mention that you were a Prosecutor for a short time, you certainly don’t want to be accused any “egregious misconduct” like the Court held you were guilty of in State v Stephens… just get it done lady!

Don’t think the Spokane Police Guild when they agreed to a contract change allowing for an OPO Commission didn’t know that any Oversight Commission would be dysfunctional, they are laughing their heads off again.
